ECEC 2020: Breakout Session Poland

Replay | Upcoming changes in law – A burden or an opportunity for companies?

The Polish Ministry of Justice has prepared another version of the draft on the liability of collective entities, which will allow companies to be punished for the actions of their employees. The amendment of polish law is based on EU regulation. However, some restrictions seems to infringe basic rights.

During this breakout session, an expert panel including Jowita Bukowinska from 321 Leader Ltd, Aneta Mioduszewska-Freundlich from Bank Pocztowy SA, Marcin Szewczak from Lubelski Węgiel Bogdanka SA, Katarzyna Kosicka-Polak from MKZ Partnerzy, and hosted by Ania Wojtus from EQS Group AG, will look at new responsibilities for companies. The panel will also look at the other side of the coin – we will consider whether (or how) new regulations may contribute to gaining a competitive advantage.

Katarzyna Kosicka-Polak | Legal Counsel, MKZ Partnerzy

Katarzyna is a co-founder and partner of the Law Firm Michalak Kosicka Zawolski i Partnerzy in Warsaw. A graduate of the University of Warsaw, Faculty of Law and Administration in Warsaw and Université Pantheon-Assas Paris II. She graduated from the French law school, Postgraduate Studies in Intellectual Property Law at the University of Warsaw and DESS (droit des affaires) at the Universié de Poitiers.

For years she has been successfully advising large business entities. She has extensive experience in working with corporates, agencies, media houses, e-commerce and companies from the luxury goods market.

At work, she places particular emphasis on effective solutions, supporting the implementation of the client’s business strategies at every stage of its development.

She is an active supporter of the activities of the professional community of legal advisers. Between 2010 and 2013 and between 2014 and 2016, she was a member of the Entry Committee operating at the District Chamber of Legal Advisers in Warsaw. From 2016 she was a Judge of the District Disciplinary Court operating at the District Chamber of Legal Advisers in Warsaw From 2020 she is Deputy Chairman of the above-mentioned District Disciplinary Court. She has keen interest in all compliance matters.

Jowita is the founder of 321leader ltd consulting firm, specializing in the fields of Financial Systems/Processes, Risk & Compliance.

She has over 20 years of experience in financial services, internal control and audit gained in publicly listed companies and also in SMEs. She acts as a business advisor in accelerators for start-ups.

She was formerly Head of Internal Audit at Benefit Systems, publicly listed company, responsible for the development of audit and compliance function.

Prior to this function she had a number of roles at Orange Polska S.A. for 10 years (Head of Internal Control, ERM, Director of Operational Resources).

Jowita began her career at KPMG. She is a graduate of the Doctoral Studies at Warsaw School of Economics, holds a Master Degree at the University of Stockholm and Cracow University of Economics.

Dr. hab. Marcin Szewczak, M.A – since 2004, he has worked for Faculty of Law, Canon Law and Administration at John Paul II Catholic University of Lublin. Legal counsel. Compliance Officer in Lubelski Węgiel Bogdanka S.A. (hard coal mine).

He graduated law at the John Paul II Catholic University of Lublin and international relations at University of Marii Curoe-Sklodowska in Lublin. He also holds a degree in Master of Arts in European Studies and Global Affairs from University of Saint Heart in Milan and Peter Pazmany Catholic University in Budapest. In 2007 he received a Doctos of Law degree, and in 2014 – a Habilitated Doctor degree, both at John Paul II Catholic University of Lublin.

He specialises in business law, administrative law and EU law. He also has experience in corporate governance.

His main focus as an expert is the experience of compliance policy development in the business area, as well as innovation of businesses. His academic achievements include numerous research projects and publications relating to the legal aspects of the regional development in the European Union including compliance issues.

He is a member ReNUAL – Research Network on EU Administrative Law and Eastern Regional Organization for Public Administration (EROPA).

Aneta Mioduszewska-Freundlich | Compliance Officer, Bank Pocztowy
Aneta Mioduszewska-Freundlich | Compliance Officer, Bank Pocztowy

Aneta has a lifetime experience in implementing compliance systems in financial sector (mostly banks) and companies listed on the Warsaw Stock Exchange (WSE), as well as managing compliance units. From 2018, she has been the Compliance Department Director at Bank Pocztowy S.A. Due to the strategic partnership with Poczta Polska S.A. (the company holds 75% minus 10 shares of the Bank), Bank Pocztowy S.A. gives its customers access to financial services through one of the most extensive branch network in Poland.

Aneta has a Legal Counsel degree and she is Certified Compliance Officer. She also holds an Executive MBA degree awarded by the Warsaw University of Technology. Before her Compliance career, she worked as a legal counsel and manager in the insurance sector.
